Question: Describe about the Intellectual Property Law?. Answer: Introduction Patent is a right which is granted to a person for his invention of either a new product or a new process. The patentee gets a right to prevent his product or process from being disposed of or used or imported without his prior permission (Sterzi 2013). Any act relating to the use or dispose of or import of any product or process on which patent has granted, without the permission of the patentee would constitute an infringement of the right which has been granted to the patentee. The patentee will then be entitled to get his right enforced in a court of law or before the Comptroller and obtain appropriate remedies (Cotter 2016). Instant Problem In the instant problem the applicant is claiming invention over a product- a machine, which sprays stale beer and attracts slugs and thereafter dusts them with an electrostatic powder which is laced with poison. The scope and protection of the patent extends to the following four claims: 1. An apparatus for administering pesticide to slugs where the slugs are attracted towards the apparatus by a substance having appropriate properties and a quantity of pesticide is discharged towards the slugs on their approach towards the apparatus; 2. An apparatus according to claim 1 where the pesticide is impregnated in an electrostatic powder which gets adhered to the slugs; 3. An apparatus according to any one of the above mentioned claims where the attractive substance is stale beer; 4. An apparatus according to claim 3 where the stale beer is sprayed towards the slugs. Issues Involved 1. Whether the applicant is entitled to get protection against infringement of the patent or not? 2. Whether the Agrico Ltd, has done an infringement of the patent by selling machines which uses stale beer to attract pests and kill them by using a dose of pesticide which is impregnated in the magnetic powder or not? Relevant Law Inventions on which Patent can be Granted Under Section 1 of the Patents Act, 1977 of UK, patent can be granted with respect to an invention (Gov.uk 2007). Certain conditions need to be fulfilled for the grant of a patent. The conditions are as follows: 1. The invention has to be new; 2. The step involved in the invention is new; 3. The invention is capable of being industrially applied (Gov.uk 2007). Infringement of Patent Infringement of patent has been dealt under Section 60. It lays down that Infringement of a patent occurs only when a patent is in force. It provides that if any person, without the consent of the patentee, does any of the below mentioned acts in relation to the invention, then it would amount to infringement of patent. The acts are as follows: 1. If the invention relates to a product, infringement occurs when the product is disposed of or is offered to be disposed of or is used or imported or kept by such person. 2. If the invention relates to a process, infringement occurs when the process is used or is offered to be used, where any reasonable person of a prudent mind is of the opinion that such a use would amount to infringement. 3. If the invention relates to any process, infringement occurs when a product obtained by such a process is disposed of or is offered to be disposed of or is used or kept by such person (Torremans 2013). Rights Conferred to a Person whose Application for Patent has been Published Section 69 specifically gives right to a person whose application for patent has been published (Gov.uk 2007). The section provides him with the same rights as an original patentee gets under Section 60, subject to two conditions which are explained later in this paper. Application of the Relevant Law In the instant case, patent has still not been granted. Therefore Section 69 will apply in this case. Now protection is granted to an applicant of a patent on the fulfilment of two conditions: The applicant is only allowed to bring a suit only when there has been a grant of patent and The second condition is that the act would have infringed the patent as well as the claims laid down in the application if the patent would have been granted at the date when the application was published. In the instant case: Claim 1 would have been clearly infringed had the patent been granted on the date when the application was published. Claim 2 would have not been infringed because Agrico Ltd is not using electrostatic powder; instead it is using magnetic powder. Claim 4 would have also been infringed as the machine produced and sold by Agrico Ltd. Uses stale beer towards the direction of pests, including slugs. Conclusion The machine, which the Darkland research Ltd. has created, is a new invention and it involves an innovative step of killing slugs. Though the idea of attracting slugs is not new but the methods and steps involved in the use of machine represent an improved method of attracting slugs and thereafter killing them with pesticides. The product is also capable of being industrially applied. Thus the product is an invention and the Company has rightly applied for the grant of patent. The Company, Agrico Ltd., on the other hand has used the same steps to kill pests including slugs. It has almost used the same steps as had been invented by the applicant. The only change which this company has introduced is the use of magnetic powder in place of electrostatic powder but the overall idea is the same. Thus, it has been established that if the patent would have been granted on the date when the application was published, the act done by Agrico Ltd. Company would have clearly infringed both the patent and the claims referred to in the application filed by the Company, Darkland Research Ltd. Under the relevant provisions of the UK Patent Act, 1977 the applicant is entitled to bring a suit against the company Agrico Ltd. But this suit can only be brought once the patent has been granted. Kate Chopin Kate Chopin is a brilliant writer. Her writing career is during the late 1800's. She lives in a time where women are sexually suppressed and their opinions are not valued. Her writing holds more in common with our time than the time just after the Civil War. Although her life was full of death, she still lived as happy a life as she could by writing in such a bold and daring way. Kate Chopin was born as Catherine O'Flaherty. She was born July 12, 1850. She is the daughter of Thomas and Eliza O'Flaherty. Kate's father, Thomas O'Flaherty, was born in Ireland in 1805. He came to the United States in 1823. In 1825 he became a merchant in St. Louis. In 1855 he died suddenly in a train wreck when she was only four. His sudden death pushed all his family into new relationships with each other and the world. Thomas' first wife, Catherine de Reilhe, married Thomas in 1839. She was a French-Creole girl, who died after giving birth to their son, George. In 1844, Thomas married Eliza Faris. They had three children together: Jane, who died at childbirth; Thomas Jr.; and Catherine, who we know as Kate Chopin. After the father's death, Eliza had to cope with being a widow. Kate's childhood consisted of a widowed mother, and a widowed great-grandmother. As a child, Kate experienced many deaths. She became emotionally close to her half brother George O'Flaherty. George was a Confederate solider during the Civil War and died from typhoid fever after being released from prison in 1862. After her father and brother's death, Kate seemed to have collapsed. She became faintly ill, and it took her two to three years to recover the traumatizing events of her childhood. These events changed her permanently which made her very wary. Kate's great-grandmother, Madame Charleville, taught her French. In fact, that was the only thing she would speak around Kate. Madame Charleville would tell Kate stories about the French. Giving Kate a history lesson about how the French founded the city along the banks of the Mississippi. Some of these stories were false, but Kate didn't know the difference. They were just, "being no more than the scandals of another day" (Magill 205). In the end, Kate received an altogether unconventional education from her great-grandmother. Kate began a more conventional education at the Madames of the Sacred Heart Convent in 1860. There, the nuns taught her discipline and a respectable academic curriculum. Kate also along with English, learned French literature as well. Kate began to play the piano at an early age. "Kitty Garesche recalls Kate being an accomplished pianist with an exceptional musical memory" (Baechler 68). Kate began her music with her great-grandmother supervising her piano playing. The great-grandmother would sit patiently with Kate as she practiced her scales. She done this to teach her the importance of discipline and technique. During her schooling with the Madames of the Sacred Heart, the nuns encouraged Kate to continue with her piano playing. "By the time she reached adolescence, Kate O'Flaherty was an accomplished musician" (Unger 205). "In June 1868, Kate graduated from the St. Louis Academy of the Sacred Heart. She then plunged into the fashionable life, and for two years she was...'One of he acknowledged belles of St. Louis'" (Skaggs 2). After Kate's graduation, she emerged from the dark period of her brother's death, Kate became a popular young woman. In 1869 she began to smoke, which is highly unusual for a woman in those days. "For two years Kate lived a life of an attractive girl in the ?high society' (of French Origin) in which her mother moved" (Kunitz 150). She was greatly fascinated by all the varieties of people she met in New Orleans."She met aristocratic Creoles, unpretentious Cajuns (or Acadian: French pioneers who in 1755 had chosen to leave Nova Scotia rather than live under the British), Redbones (part Indian, part white), ?Free Mulattoes' (so called because they had never been slaves), blacks, and a cosmopolitan assortment of Germans, Italians, Irish, and Americans" (Baechler 68). My Desire to Teach Literature A couple of months ago, out of curiosity, I engaged in a test offered by the MENSA association. Along with the I.Q. figure, I received there was also some two word description attempting to label my intellectual prowess. As I recall one of the words was â€Å"intuitive†, or some variation thereof. People with a propensity to intuitiveness generally have some sense of this. Call it intuition. As a learner I would have to say that I fall into the visual category. For an instructor to describe a mathematical formula, for example, it just does not have the impact as to actually see the process worked out on a blackboard. The same applies to a tangible object. I am able to fully grasp its applications if it was placed before me, as opposed to being merely explained. I do intend to teach in the visual style when, at last, that role is mine. Ultimately my goal is to teach college level literature. Off hand I can think of a few instances where visual tools might be employed in this arena. Suppose I was to assign a class to read Joseph Heller’s â€Å"Catch 22†. Clips from Mike Nichols’ film version would give the class a firmer grasp on the insanity of war. Gustave Dore’s sullen and intense companion paintings to Samuel Taylor Coolidge’s â€Å"The Rime of the Ancient Mariner† would assist in bringing students closer to the mood and drama the poem evokes. And why stop with artistic mediums. Nature herself is the ultimate instructor. After a reading of Emily Bronte’s â€Å"Wuthering Heights† I can see myself marching a class out into a rainfall (weather permitting) and proclaiming â€Å"O.K., guys. You feel those cold drops pounding you? Feel the general wildness of it all? That, my fr iends, is unbridled passion. That is Cathy and Heathcliff in a nutshell.† Regarding the application of learning styles and learning style assessments, quite honestly, I don’t know enough about it yet to make a judgment call. This is new to me and I am still learning. From what I understand of some of these issues, such as integrated learning, this is a practice that should be administered to students at a lower grade level.

The Theme of Betrayal and Loyalty Through the Eyes of Desdemona, Othello, and Iago The play The Tragedy of Othello the Moor of Venice, written by William Shakespeare in the 1600’s, has many underlying and reoccurring themes. The major themes are betrayal and loyalty. During the entire play, every character is either betrayed or proved loyal. The Tragedy of Othello the Moor of Venice can be seen through the characters of Iago, Othello, and Desdemona. Othello and Desdemona have both been betrayed in their attempt to be loyal to another character.Throughout the play, Iago manipulates the other characters into betraying one another so that he can get his ultimate betrayal on Othello. Shakespeare uses Iago as the main portrayer of betrayal throughout the entire play. He betrays all the other characters, but his main focus is on Othello. Despite that, he ends up betraying all the people closest to him. Iago’s betrayal starts off from the first scene page of the play right unt il the end. The audience learns Iago’s motive through his monologue: â€Å"Thus do I ever make my fool my pursel hate the moor, and it is thought abroad that ‘twixt my sheets’ has done my office.I know not if’t be true, but I, for mere suspicion in that kind will do as if for surety. † Iago suspects that Othello has had an affair with his wife. However, Shakespeare makes Iago’s motif very unclear; therefore, it can be argued that this is Iago’s excuse and in actual fact he has no reason other than he simply hates Othello. Iago wants to destroy Othello because Othello promoted Casio as chief lieutenant instead of him, which is another reason why Iago wants to destroy him. Iago is one of Shakespeare’s most complex villains. Initially, we see Iago’s character as pure evil, yet later we see him as a completely amoral person.Iago does not push aside his conscience to commit his evil plans, he simply lacks a conscience to begin with. Through Iago, Shakespeare shows us a character that acts against his reputation and betrays all this friends and loved ones. Through some careful thought out words and actions, Iago is able to manipulate others to do things in a way that benefits him and moves him closer to his ultimate goal. He is the main driving force of the play, pushing Othello and everyone towards their tragic end. Iago is smart. He is an expert judge of people as well as their character and uses this to his advantage.Iago is also quick on his feet, making him able to improvise when something unexpected occurs. Being as smart as he is, Iago is quick to recognize the advantages of trust and uses it as a tool to forward his main purpose. Throughout the story he is commonly known as the â€Å"honest Iago†. He even says himself, â€Å" I am an honest man†. Trust is a very powerful emotion that is easily betrayed. Iago is a master of betrayal. He slowly poisons people’s thoughts, creatin g ideas in their heads without risking himself. Iago is capable of anything, not even the brave soldier Othello is safe from this villain.Othello holds Iago to be his closest friend and advisor. He believes Iago to be a person, â€Å"of exceeding honest, who knows all qualities with learned spirit of human dealings†. Yes, he does know about human dealings, but he is not the honest man he appears to be. He uses Othello’s trust in him to eventually turn Othello into a man no better than himself. Othello is introduced to us in the first scene of the play in a negative light, when Iago and Rodrigo refer to him using derogatory terms such as, â€Å"The Moor†, â€Å"the thick lips†, â€Å"an old black ram† and â€Å"a Barbary horse†.Othello may be an outcast in Venice due to the color of his skin; however, he is a highly respected soldier. He is extremely skilled in his field and a loyal man; therefore, valuable to the state. Due to this, we soon learn of Othello as the noble man he is. Othello, however, has the â€Å"tragic flaw†. It is the internal imperfection in a hero that brings him down. His downfall becomes his own doing; he is no longer the victim of fate. The prejudice of those around him destroyed him, and they believed that, â€Å"A black man is an unattractive creature, not quite human, and unworthy of love†.Thinking this made him unable to believe that Desdemona could truly love him. This is why he believes Iago so easily when he convinces him Desdemona has had an affair. Othello betrays his wife by believing Iago’s word over hers, this then leads him to his ultimate betrayal when he kills her at the end of the play. At this point he also shows his loyalty to her by killing himself, stating that he can’t live without her. The man we see at the end of the play is not the loyal man we meet in the beginning.Othello has let the â€Å"green eyes monster of jealousy† turn him from a loyal soldier to a betrayer just like Iago. Desdemona is a lady of spirit and intelligence; she is the most direct, honest and loyal character of the play. She only betrays people to those to who she is loyal. Desdemona is a lady of few words, yet she makes sure every word counts to get her point across. In Desdemona’s eyes, Othello is the hero of many exciting and dangerous adventures; he is the orphan who needs love. These are the reasons Desdemona had fallen in love with Othello, despite all the nasty remarks from fellow Venetian citizens.Her marriage has brought her position and happiness, so much that she finds it unbearable to think that her husband has turned against her. This numbness lasts until she sees that he actually intends to kill her. She then puts up a defense, insisting on her loyalty and innocence. In despair of losing his love, she still defends him from consequences of his actions, but he is past seeing the truth: that she has committed herself to his lo ve, and without it she cannot live. Othello ends up killing his wife, in spite of her loyalty toward him till the very end.By the end of the play, all characters have lost their loyalty to each other from what Iago as done to make them feel betrayed. Desdemona is left lifeless in her room, Iago kills his wife Emilia, as she reveals that Desdemona has been falsely accused of adultery, and Othello kills himself rather than living with what he has done. Iago is the only survivor by the end of the play, which further justifies his intelligence. All the characters have reached their downfall and Iago is finally pleased. He has completed the ultimate betrayal.
